Clause One. Identification and Purpose

1.1. Service provider identification

Social Car Cancun (hereinafter "the Platform" or "the Intermediary") is a digital platform operated by an individual with business activity, with tax domicile at Av. Encarnación Ortiz 1860, Mexico City, Mexico City, C.P. 02950, Mexico. For any legal communication or notification, the official email is: info@socialcarcancun.com.mx

1.2. Nature of the service

The Platform acts exclusively as a technological intermediary between the user (hereinafter "the Client") and the final provider of private ground transportation services called Total Transfer (hereinafter "the Provider" or "the Carrier"). Social Car Cancun is not a transportation company, does not own vehicles, nor directly employs the drivers who provide the transfer service.

1.3. Purpose

These Terms and Conditions regulate access to and use of the socialcarcancun.com.mx website, as well as the contracting of private transfer services from Cancun International Airport to various destinations in the Riviera Maya, and vice versa, including transfers between hotels and tourist areas.

Clause Two. Acceptance of Terms

2.1. By accessing, browsing, or using the Platform, as well as by making any reservation, the Client declares having read, understood, and fully accepted these Terms and Conditions, agreeing to comply with all their provisions.

2.2. If the Client does not agree with any of the provisions established herein, they must refrain from using the Platform and its services.

2.3. Legal capacity. To use the Platform's services, the Client must be over 18 years of age and have legal capacity to contract. By making a reservation, the Client declares under penalty of perjury that they meet these requirements.

Clause Three. Description of Services

3.1. Services offered

Through the Platform, the Client can book the following private ground transportation services, which are executed by the Provider:

  • Private door-to-door transfers from Cancun International Airport to destinations in the Riviera Maya (from Costa Mujeres to Tulum)
  • Return transfers from hotels and tourist areas to the airport
  • Transfers between hotels and tourist areas
  • Airport reception service (meet & greet)
  • Real-time flight monitoring
  • Child car seats (upon request with minimum 48 hours advance notice)
  • Quick 15-minute stop at convenience store (upon request)

3.2. Service characteristics

All vehicles used have air conditioning, are properly insured, and are operated by authorized drivers wearing uniforms and company identification. Drivers will wait for the Client at the designated meeting point with a sign bearing their name.

3.3. Airport meeting points

For Terminals 2 and 4, the meeting point is located next to the Welcome Bar. For Terminal 3, the meeting point is located next to the Margaritaville Bar. Airport staff can guide the Client to these points.

3.4. Post-landing communication

Once the Client's flight lands, the operations team will send a message with detailed instructions to reach the meeting point. It is the Client's responsibility to respond to messages, calls, or SMS to avoid delays in service coordination.

Clause Four. Reservation and Payment Process

4.1. Reservation

Reservations are made directly through the Platform without the need to create a user account. The Client must provide accurate and complete information to ensure proper service delivery.

4.2. Payment options

The Platform offers the following options:

  • Pay 20% online and the rest in cash or via payment link on the day of service
  • Pay 100% online at the time of booking
  • Book now and pay later (a reminder will be sent 2 days before arrival)

4.3. Accepted payment methods

Only credit cards, debit cards, and cash are accepted. PayPal is not available as a payment method.

4.4. Payment processing

Online payments are processed through Stripe, a certified platform that securely manages sensitive payment information. Social Car Cancun does not store complete credit card numbers or sensitive financial data.

4.5. Confirmation

Once the reservation is completed and payment received, the Client will receive an email confirmation with the details of their service.

Clause Five. Cancellation and Refund Policy

5.1. Free cancellation. The Client may cancel their reservation free of charge up to 24 hours before the scheduled flight arrival time or the agreed transfer time.

5.2. Late cancellation. Cancellations made less than 24 hours in advance are non-refundable.

5.3. No-show. If the Client does not appear at the agreed meeting point without prior notice, no refund will be issued.

5.4. Missed flight. If the Client misses their flight, they must notify the Platform immediately. Since the vehicle is scheduled based on flight data, if it has already arrived at the airport and the Client does not show up, a refund may not be possible.

5.5. Date or time change. Date or time changes must be requested at least 24 hours in advance. If the new transfer time is at night (between 10:00 PM and 6:00 AM), an additional charge of 50% of the original fare will apply.

5.6. Airline flight cancellation. If the airline cancels the Client's flight, the Platform will assist in rescheduling the transfer at no additional cost, subject to availability.

5.7. Medical emergencies. In case of a duly documented medical emergency, the Client should contact the Platform to have their case evaluated on an individual basis.

5.8. Severe weather or natural disasters. If travel becomes impossible due to severe weather conditions or natural disasters, and the Client notifies at least 24 hours in advance, a full refund will be granted.

5.9. Provider non-compliance. In case the Provider cannot fulfill the service (vehicle not available, inability to reach the meeting point, etc.), Social Car Cancun will manage the resolution according to this cancellation policy. If the service cannot be provided due to reasons attributable to the Provider, a full refund of the amount paid will be made.

Clause Six. Additional Charges

6.1. Night transfers due to flight delay. If the Client's flight is delayed and arrives during night hours (between 10:00 PM and 6:00 AM), an additional charge of 50% of the contracted fare will apply.

6.2. Additional stops. One quick stop of up to 15 minutes at a convenience store is permitted upon request. Additional or longer stops may incur extra charges.

Clause Seven. Limitation of Liability

7.1. Intermediary nature. Social Car Cancun acts solely as a technological intermediary between the Client and the Provider. The Platform facilitates the connection and manages reservations but does not directly execute the transportation service.

7.2. Provider responsibility

The Provider (Total Transfer) is solely responsible for:

  • The execution of the transportation service
  • The condition and maintenance of vehicles
  • The conduct, training, and authorizations of drivers
  • Compliance with applicable traffic and transportation regulations
  • Civil liability insurance coverage for each passenger

7.3. Exclusion of liability

Social Car Cancun shall not be liable for:

  • Direct or indirect damages arising from the provision of transportation service
  • Personal injuries, loss, or damage to luggage during transfer
  • Delays caused by traffic conditions, weather, or force majeure
  • Acts or omissions of the Provider or its drivers
  • The availability, suitability, or quality of vehicles used

7.4. Insurance. All vehicles used for the service have civil liability insurance contracted by the Provider, which covers each passenger during the transfer.

7.5. Management commitment. Notwithstanding the above, Social Car Cancun commits to managing any Client claim with the Provider and seeking satisfactory solutions in accordance with the policies established in these Terms.

Clause Eight. Client Obligations

8.1. The Client agrees to:

  • Provide accurate, complete, and up-to-date information at the time of reservation
  • Arrive punctually at the agreed meeting point
  • Carry valid official identification
  • Maintain active communication with the operations team
  • Behave respectfully toward the driver and take care of the vehicle
  • Comply with applicable rules and regulations during the transfer

8.2. Flight information. It is the Client's responsibility to correctly provide the flight number, airline, date, and arrival time. Errors in this information that prevent proper service delivery shall not be the Platform's responsibility.

Clause Nine. Personal Data Protection

9.1. Data collected

For service provision, the Platform collects the following personal data:

  • Full name
  • Email address
  • Phone number
  • Flight details (number, airline, date, and time)
  • Transfer destination
  • Basic payment data (name and email associated with the transaction)

9.2. Sensitive payment data. Sensitive financial information (card numbers, CVV, expiration date) is processed and stored exclusively by Stripe, a provider certified under PCI-DSS standards. Social Car Cancun does not have access to this data.

9.3. Use of data

Personal data will be used to:

  • Process and confirm reservations
  • Coordinate service delivery with the Provider
  • Send service-related communications
  • Address requests, complaints, or claims
  • Comply with legal obligations

9.4. Data transfer. Data necessary for service provision will be shared with the Provider (Total Transfer) for proper transfer execution.

9.5. ARCO rights. The Client may exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO) regarding their personal data, in accordance with the Federal Law on Protection of Personal Data Held by Private Parties, by sending a request to: info@socialcarcancun.com.mx

9.6. Legal framework. Personal data processing is carried out in accordance with the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations.

Clause Ten. Intellectual Property

10.1. All Platform content, including but not limited to texts, graphics, logos, icons, images, audio and video files, software, and source code, are the property of Social Car Cancun or its licensors and are protected by applicable intellectual property laws.

10.2. Reproduction, distribution, modification, transmission, or unauthorized use of any Platform content without prior written consent from Social Car Cancun is prohibited.

Clause Eleven. Customer Support

11.1. Social Car Cancun offers customer service 24 hours a day, 7 days a week, via WhatsApp, phone, and email.

Clause Twelve. Modifications

12.1. Social Car Cancun reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon publication on the Platform.

12.2. Continued use of the Platform after any modification constitutes acceptance of the new Terms and Conditions.

12.3. The Client is advised to periodically review these Terms to stay informed of any changes.

Clause Thirteen. Applicable Law and Jurisdiction

13.1. These Terms and Conditions are governed and interpreted in accordance with the laws in force in the State of Quintana Roo, United Mexican States, including the Federal Consumer Protection Law, the Civil Code for the State of Quintana Roo, and other applicable regulations.

13.2. For the interpretation and compliance of these Terms and Conditions, as well as for the resolution of any dispute that may arise therefrom, the parties expressly submit to the jurisdiction of the competent courts of the State of Quintana Roo, Mexico, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.

Clause Fourteen. General Provisions

14.1. Entire agreement. These Terms and Conditions constitute the entire agreement between the Client and Social Car Cancun regarding the use of the Platform and the contracting of services, and supersede any prior agreement or understanding, whether verbal or written.

14.2. Severability. If any provision of these Terms is declared null, invalid, or unenforceable by a competent authority, such provision shall be considered separate from the rest of the document, which shall maintain its full validity and effect.

14.3. Assignment. The Client may not assign or transfer their rights or obligations under these Terms without the prior written consent of Social Car Cancun.

14.4. Waiver. The failure of Social Car Cancun to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.5. Force majeure. Neither party shall be liable for non-compliance with their obligations when caused by force majeure events, including but not limited to natural disasters, pandemics, acts of war, terrorism, strikes, or any other event beyond the reasonable control of the parties.
